1. Your Order
1.1. You accept The Sleep Shop terms and conditions when you tick "I confirm that I have read and agree to the Terms of Sale" during the checkout process. In confirming this you enter into a binding contract with us, the retailer and you, the customer.
1.2. When confirmation of order is received, this is to indicate that we have received your order. It does not indicate that a contract exists between us. We will indicate acceptance of your order, and hence a contract between us, when we send you an invoice. We have the right to refuse any order for any reason should we see fit to do so.
1.3. You will be responsible for any information submitted to us throughout the order process and the accuracy of this information given. When requested you will provide us with correct information such as contact numbers and emails as these are necessary to the sale to ensure the delivery is correct and you can be notified throughout the order and despatch process.
1.4. When contacting The Sleep Shop after point of sale you quote us a billing postcode or order number so we can accurately and efficiently check any enquiries you have
1.5 If we have inadvertently under-priced goods, or we are no longer able to supply a particular product for some reason we will always notify you and not have to fulfil the order at the incorrect price. In the case of a change of price, we will always contact you first to ensure that the price is acceptable.
2. General Sales
2.1. All purchases must be paid in full before despatch. FGS Furnishings Ltd has the right to hold any goods with ourselves until payment has been received and cleared in full.
2.2. Payments are accepted on most credit or debit cards via our secure server; we do not accept American Express. We authorise you to make any enquiries you deem necessary in connection with this sale to aid fraud prevention or debt recovery.
2.3. If you are shopping from North America or anywhere else, place your order and your credit card company will convert the transaction to US Dollars or your own currency.
2.4. All prices quoted are for brand new, manufactured sealed products and are priced in British Sterling Pounds and including VAT.
2.5. Mattress only price includes delivery to any mainland UK address Monday to Friday. Other Furniture will incur delivery fees, these will be automatically added at checkout where the order value is less than £300.00. If an order value is more than £300.00 any delivery charges will be deducted (excludes, pillows/accessories). Additional charges will be incurred for delivery to the Scottish Highlands, Grampians and Northern Ireland.
2.6. Saturday deliveries are possible at an additional cost of £30 dependent on areas available.
2.7. An invoice/ order confirmation giving a description of the goods purchased and the price paid will be emailed to you once the order has been processed internally.
3.1. Delivery times will depend on the item purchased. If your item is out of stock, our delivery lead times will be clearly detailed on the product page however should the item be unexpectedly out of stock we will contact you to notify of any delay to the order.
3.2. Items we carry in stock are normally despatched within 24 hours for delivery the next working day or on the day you specify at the point of order. We will try to meet most delivery requests but please bear in mind lead times on certain orders.
3.3. All delivery times are subject to stock availability and to payments being checked and cleared prior to despatch. We will also need to ensure details are correct so if an incorrect phone number or address is given this can delay deliveries until we have clarification.
3.4. Wherever possible we will attempt to deliver the goods using our own delivery drivers and vehicles. However in order to offer the most efficient delivery service possible we reserve the right to use a courier of our choice.
3.5. All delivery dates are given in good faith but are subject to all matters beyond the control of the Company: including acts of nature, strikes, and delays by suppliers/ couriers. We will endeavour to do our best to keep you notified of any delays.
3.6. Please ensure you check your items thoroughly on delivery for damage. If upon delivery you find your goods are damaged, please sign for them as "Damaged" and refuse delivery. We would also advise calling our office at point of a damaged delivery to notify us and see the best next steps.
3.7. The Sleep Shop must be notified of any damage to items within 24hours of delivery
3.8. Please be aware The Sleep Shop's cut off time for next day delivery is 4 pm (Excludes Pillows). Our courier leaves our warehouse at 4 pm; Once the courier has left the order is classed as despatched. Once an order has been despatched and the buyer wishes to cancel
the order the buyer will be responsible for a returns fee of £40. The £40 will be deducted from the full refund that will be processed once the goods have arrived back at The Sleep Shop's warehouse.
3.9. Pillow orders need to be processed by 1pm for next working day delivery as the courier leaves our premises by this time.
3.10. Vacuum packed rolled mattresses need to be ordered by 11am to guarantee next working day delivery.
3.11. Deliveries to the following postcodes may take a little longer - please allow 3-14 days for deliveries to AB, BT DD, HS, IV17-99, KA27, KW, PA20-80 and PH33-49, ZE.
3.12. We do not deliver to Southern Ireland, Channel Islands or outside Mainland UK.
3.13. Our one man delivery service, the courier will bring your item to the ground floor entrance only.
3.14. Our two man delivery service is to the room of choice where accessible and safe to do so, and at owners risk. Please note that the service is restricted to no higher than a 3rd floor with or without suitable lift access. For insurance purposes they will not carry any higher than a 3rd floor.
3.15. It is the responsibility of the customer to notify The Sleep Shop of the delivery address being in an area of inaccessibility due to restricted roads or other geographical difficulties.
3.16. If we cannot deliver on the arranged day we will inform you as soon as possible. In some circumstances it may not be possible to inform the customer until the day of delivery. The Sleep Shop is not liable for any loss suffered in these circumstances
3.17. In the event of delivery being unsuccessful you will be offered an alternative delivery date.
3.18. Neither The Sleep Shop nor the couriers they use will be able to deliver on Sundays or Bank Holidays. Saturday deliveries are available at a premium charge.
4. Accuracy of Information Provided
4.1. The Sleep Shop will try to give the most accurate description and representation of the item you will receive and mainly come directly from the manufacturers. If you are unsure or require further information, we advise contacting one of our customer service team.
4.2. The illustrations and colours are representations only but if you would like a swatch of fabrics please contact our customer service team and we will try our best to obtain these for you.
4.3. All sizes and depths are correct according to the manufacturer's descriptions however there can be slight variations to these and we will make every attempt to ensure these are accurate at the time of buying but we reserve the right to change specifications as advised by manufacturers.
4.4. All items are subject to availability.
4.5. Responsibility for checking the dimensions of your bed or mattress lies solely on you as the customer. This is also applicable for ensuring the mattress will fit in the property and room prior to deliver with ease. FGS Furnishings Ltd cannot be held responsible for customers ordering the incorrect size or not checking the access to property prior to purchase. If you need any clarification to the sizing or accessibility, then please speak to our customer services line prior to ordering.
5. Bed Sizes
5.1. There are no lawful guidelines for sizes of beds that have to be used. The size of the product is used for descriptive purposes but there is no guarantee that it will fit across two different suppliers. For example, a double mattress from one manufacturer may differ in size of the base from another manufacturer. This may predominately be down to the difference between Metric, Imperial and European dimensions.
5.2 Mattresses are made with many individual components such as springs, casing and fillings. It is therefore necessary to allow a tolerance to the width and length of your mattresses, at a guide of an allowance of +/- 1 inch (2.54cm).
5.3. Please be aware that when converted, metric sizes are not exactly the same as imperial sizes. Below are all the sizes of mattresses we sell and beds that fit these sized mattresses:

6. Warranty & Guarantees
6.1. All items are guaranteed for a minimum of 12 months, some will be longer dependent on manufacturer.
6.2. All goods sold by The Sleep Shop comply with all applicable legislation and consumers are reminded that these items and conditions do not affect your statutory rights under Distance Selling Regulations.
6.3. In the unlikely event you do have a warranty claim, we would send you a template of all the information and images we need. Upon receiving these we will then liaise with the manufacturer on your behalf.
6.4. With certain manufacturers there will be charges applied within the warranty after 12 months. Any charges will be outlined during the warranty claim process. The amount will be dependent on the item and manufacturer.
7. Right of Cancellation
7.1. The customer has a right to cancel the order at all points.
7.2. You must express your right to cancel the order by informing FGS Furnishings Ltd in writing to our postal address, via email before the goods are despatched or via telephone communication.
7.3. Customers wishing to cancel their order after dispatch must ensure that the item(s) remain in the sealed manufacturers packaging ‘new’ and unused. Any item returned that has been removed from the manufacturers packaging will be rejected and a refund will not be applicable.
7.4. If the goods have been despatched the customer will be liable for a restocking charge of £40. This will be deducted from any refund once the goods have been received back to our warehouse.
7.5. To accept an item for return we must be notified in writing within 14 days of delivery. A collection will then be arranged for the earliest date convenient.

8. Damaged / Disputed Goods
8.1. We will exchange any product that is either damaged or faulty upon delivery, providing we are notified with 24 hours and only when the customer has complied with all our terms and conditions.
8.2. Before processing a damaged goods claim, we will require a photograph of the damaged goods to action the complaint and progress the dispute.
8.3. It is the responsibility of the customer to check the goods have been delivered in good condition and if they are damaged or unchecked to sign as ‘damaged’ or ‘unchecked’.
8.5. If you sign for an item as delivered in good condition and you subsequently notice damage this may affect the right to exchange the item.
9.1. FGS Furnishings Ltd will refund the purchase price of the goods within 14 days of receiving the goods back in our warehouse and checking the returned goods are sealed and complete minus any restocking fee.
9.2. Customers who refuse delivery at the door will still be liable for a restocking charge of £40 as the items have been despatched from our warehouse.
9.3. Unfortunately we will not accept a return or process a refund on an item that has been removed from the sealed manufacturers packaging as this becomes classed as a ‘used’ product.
9.4. The Sleep Shop must be notified within 14 days of any request to return the item.
9.5. FGS Furnishings Ltd cannot be held liable for items ordered incorrectly, in the incorrect size or unable to fit in the customers property. The responsibility is on the buyer to check this prior to purchase.
10.1. All prices shown on the website are inclusive of VAT and a VAT applicable invoice will be emailed to you automatically upon placing your order.
